Between 9th July and 30th September 2014, the Department consulted upon the draft Waste Management Licensing (Amendment No. X) Regulations (Northern Ireland) 2014 which detailed proposed amendments to the prescribed offences and technical competence elements of the Fit and Proper Person test (FPP test) established by way of regulations 2-5 of the Waste Management Licensing Regulations (NI) 2003 (the 2003 Regulations).

As a result of issues raised during the consultation process, it was decided to revisit the draft Regulations. This consultation is on the amended proposals. A key difference is that it has been decided to amend the prescribed offences and technical competency elements of the 2003 Regulations separately.

This consultation is seeking comments on the revised proposals relating to the prescribed offences element of the FPP test only. The purpose of the Draft Regulations is to reduce criminality in the waste sector by:

  • updating and broadening the list of prescribed offences to include ‘reputational’ convictions and remove regulations that are no longer extant
  • replacing the current regulation 2 of the Waste Management Licensing Regulations (NI) 2003 with a new regulation 2 which creates an amended list of prescribed offences which will be in the form of tables contained in a new Schedule 6

Revoking Schedule 1 of the Controlled Waste (Registration of Carriers and Seizure of Vehicles) Regulations (Northern Ireland) 1999[[1] SR 1999 No. 3621] (the 1999 Regulations) and attracting the offences prescribed in the 2003 Regulations.
